Trademark registration begins with a thorough legal and strategic assessment. If you wish to protect a company name, product name or logo, we provide individual guidance and assess the registrability.

At the beginning, we clarify together which sign you want to protect – such as a company name, a product identifier or a logo – and check whether it is eligible for registration under trademark law. This is followed by a search to ensure that no identical trademarks already exist. This prevents later conflicts with older rights.

We also advise start-ups and young companies on questions of trademark ownership. Especially when several founders, shareholders or companies are jointly involved in a trademark, it is important to clarify early on who owns the trademark – and who has which rights to it.

Together with you, we develop a protection strategy that aligns with your business goals. We advise you on whether national protection (e.g. at the DPMA), EU-wide protection (EUIPO) or an international registration via WIPO makes sense.

We also advise you on the selection of the appropriate trademark form: Should your sign be protected as a word mark, figurative mark or word/figurative mark? Is a modern trademark form such as colour mark, position mark, motion mark or series mark suitable? We check which form offers the best protection.

We also include strategic questions about trademark architecture – such as securing individual product names, series marks or combination signs – in our advice. This creates tailored trademark protection that is economically sensible and secures your brand identity in the long term.

Trademark application process

 

 

We guide you step by step through the procedure. The application is submitted electronically to the respective intellectual property office. The day on which the application is received is recorded as the filing date – a legally significant point in time. Trademark protection takes effect retroactively from this date, provided that the trademark is actually registered later. After the application, the office checks whether so-called absolute grounds for refusal exist – for example, whether the trademark is merely descriptive.

If the application is not objected to by the office, the three-month opposition period begins. During this time, third parties can file an opposition to the trademark. If no opposition is filed or is rejected, the trademark is registered. From this point on, full trademark protection exists – third parties may not use identical or similar signs for comparable goods or services without your consent.

Costs and funding opportunities for SMEs

For small and medium-sized enterprises, we check whether funding through national or European programmes is possible. We handle the application procedures for you within the framework of the EUIPO SME Fund (“Ideas Powered for Business”) and support you with applications in the WIPANO funding programme.

The EU’s SME Fund enables a reimbursement of 75% of the official fees for trademark applications. The funding is available in limited quantities and must be applied for in good time. We handle the complete processing for you.

The WIPANO programme is aimed at German companies with research or development activities. It promotes, among other things, legal and official costs for industrial property rights. The funding rates are 50% up to a maximum of €16,600 per project.
